They found out BEFORE placing their meal, so it's not like they were suddenly forced to use the ATM. They had the choice of going somewhere else. Look at section 9.12.3. Actually, having a minimum charge requirement is against merchant account rules, though I know a lot of vendors do it. They can have their merchant account revoked.
